The RoHS Directive was transposed through the Restriction of Use of Hazardous Substances in Electrical and Electronic Equipment Regulations, 396/2004, published on 31 August 2004. WEEE is covered by a number of texts:
• The Eco-Contribution Act, in force since 1 September 2004, enables the VAT department to charge importers a tax on WEEE. The possibility for exception is foreseen, but the conditions are not specified.
• The draft Waste Management (WEEE) Regulations 2004 were published on 22 October 2004 for consultation. They transpose the EU WEEE Directive very closely.The Malta Environment and Planning Authority, has invited a commission of government and private sector representatives to define conditions for the exemption from the Eco-Contribution.
